Garissa Petitioner Sues Parliament Over Police Commission Bias

A petitioner from Garissa has taken the National Assembly to court, accusing lawmakers of ignoring President William Ruto’s directive to ensure regional balance in the appointment of members to the National Police Service Commission (NPSC).

In filings submitted to the High Court, Rukia Mohamed names the National Assembly, the selection panel responsible for vetting nominees, and the Public Service Commission as respondents.

She argues that, despite the President’s explicit instruction to consider Kenya’s former provincial regions, the final list of nine commissioners came overwhelmingly from counties clustered in the South-Western part of the country.

Represented by Sallah & Advocates, Ms Mohamed contends that the appointments overlooked entire regions particularly Eastern and North Eastern Kenya despite longstanding concerns over representation in national institutions. She says the appointments instead favoured individuals from South Rift (three), Central (two), Western (two), Nyanza (one) and Coast (one).

Her petition asks the court to compel the respondents to disclose the criteria, formula and scoring system used during the recruitment, including interview recordings, appraisal forms and the shortlist submitted to the President. She maintains that full transparency is necessary to establish whether the process met constitutional standards on diversity and inclusivity.

She cites a June 9, 2025 report by the National Assembly’s Departmental Committee, which acknowledged that President Ruto had earlier rejected a list of candidates for similar reasons, saying they failed to meet constitutional, statutory or representational thresholds and ordered the selection panel to restart the recruitment.

Ms Mohamed says she had raised concerns months earlier. A petition she filed with the National Security Committee on 14 July 2024 was acknowledged, she says, but later dismissed in the committee’s report, which claimed it had received no memoranda opposing the nominees.
