A court has halted the recruitment of senior secondary school teachers in Garissa, Wajir, Mandera and Lamu after contract tutors challenged the process, claiming they were unfairly locked out of jobs they already do.

The Employment and Labour Relations Court issued the orders after three teachers working in the volatile regions filed a petition accusing the Teachers Service Commission (TSC) of discrimination.

The teachers told the court they have served in hardship areas for years under short-term contracts and had a legitimate expectation of being absorbed on permanent and pensionable terms.

Instead, they say, they were shocked to see TSC advertise the same positions they currently occupy, forcing them to reapply like new entrants.

They pointed out that JSS interns are being confirmed into permanent positions without being subjected to a fresh recruitment process.

The dispute stems from a TSC advert placed in November 2025, seeking to fill 2,082 senior secondary school vacancies created through attrition, including posts in the four counties.

The court has now temporarily stopped the recruitment exercise in Garissa, Wajir, Mandera and Lamu, pending the hearing and determination of the case.
